The ratification of the Nagoya Protocol is not technically an expected output of the project (it was considered to be in finalization phase prior to project launch), the higher visibility of the ABS issue brought by the draft ABS legal framework will allow the MEME to further push for the ratification. Key next step is to accelerate the adoption process of the ABS legal framework.

Ministry of Energy, Mines and Environment (MEME) and Government General Secretariat 2021/06 Initiated History
The ABS mechanism developed under the project is based on existing processes to grant access to biological resources by various Departments in government. This interim system can be used to process ABS requests by potential bio prospectors while the legal framework is adopted and implemented. All ABS requests are to be sent to the respective sectorial committees, under coordination from the MEME, to follow due process for granting access, while benefit-sharing clauses will be examined by the National Committee on Biodiversity (NCB), namely its ABS sub-committee.

NCA specialized committees are members of the National Committee on Biodiversity (NCB) who have reviewed and approved the ABS legal framework and are already capable of processing access request to genetic resources. Key next step is to accelerate the institutionalization of the NCB so they can officially support the validation of ABS contracts with sectorial committees until the national ABS legal framework is adopted.

Key Actions:

Prominent NGOs are members of the NCB, and are fully aware of the necessity to carry out further dissemination on ABS. However, their capacity to disseminate online information is not as efficient as private and government entities. Key next step is to establish partnerships between the MEME and several regional NGOs to support promotion efforts on implementing ABS and fuel public support for the finalization of the ratification process of the NP.
